General Terms and Conditions
1. scope of application and contractual partners
1.1 The following General Terms and Conditions («GTC») govern the conclusion, content and execution of contracts between the Swiss Museum Pass Foundation, Heinrichstrasse 177, 8005 Zurich, Switzerland («SSMP») and its customers in connection with the sale of services (in particular purchase contracts relating to Museum Passes).
1.2 Insofar as the purchase contract is concluded on the website operated by SSMP www.museumspass.ch («SSMP website»), the customer can view and/or save the GTC directly on the website. If the purchase contract is entered into outside the website (in particular museum pass purchases at museums, tourist offices, Swiss post offices, etc., «SSMP partners»), the GTC are deposited with the relevant SSMP partners and can be viewed directly on site.
1.3 Other contractual terms and conditions, in particular those which the Customer declares to be applicable together with the acceptance of the contract, shall only be valid if and insofar as they have been expressly accepted by SSMP in writing.
1.4 The GTC shall apply in the version valid at the time of acceptance. SSMP reserves the right to amend these GTC at any time.

3. conclusion of contract
3.1 Conclusion of contract on the SSMP website
On the SSMP website, it is possible to order a museum pass using an input mask. The input screen is merely an invitation to the customer to submit an offer to conclude a purchase contract.
A binding offer by the customer is triggered when the customer has entered all the data required for the execution of the contract in the input mask, confirmed that they have read these GTC, clicked on the „Buy Pass“ button and completed the payment process. The customer has the option of changing the data in their customer account at any time. After completing the order, the customer will receive a QR code by email, which can be used temporarily as an admission ticket for the museums until the museum pass is received.
SSMP reserves the right to accept the order. SSMP is not obliged to conclude a contract on the basis of an order. In particular, an order may be canceled or rejected if there is a violation of these GTC or a suspicion thereof. Such a case exists, for example, if a customer has not paid for a previous order. The customer shall be informed of cancelations and rejections by e-mail.
The contract shall only be concluded by an explicit declaration of acceptance by SSMP. Acceptance is declared by SSMP sending the customer an order or shipping confirmation by e-mail to the e-mail address provided.
3.2 Conclusion of contract outside the SSMP website
The museum pass can also be purchased outside the SSMP website:
If the museum pass is purchased outside the website from the SSMP partners or directly from the SSMP office, the contract between SSMP and the customer is deemed to have been concluded directly (so-called contract between attendees). The order form completed on site is considered a temporary ticket and loses its validity upon receipt of the Museum Pass (approx. 5-8 working days after purchase on site).
If the Museum Pass is ordered by telephone, the contract between SSMP and the customer is also deemed to have been concluded immediately (so-called contract between parties present). The customer receives the museum pass within 5-8 working days.
4. prices
4.1 All museum pass prices (on and off the SSMP website) are inclusive of VAT at the applicable rate.
4.2 Price fluctuations are possible. The price stated by SSMP at the time of the order or purchase shall be decisive.
5. shipping and delivery
5.1 SSMP shall inform the customer of any shipping costs incurred and any other costs in the order form immediately before the order is placed.
5.2 Unless otherwise agreed, the museum pass will be delivered to the address specified by the customer. SSMP shall inform the customer of the delivery period during the ordering process or in the order or shipping confirmation. Unless otherwise stated, the delivery period for standard shipping is 2 to 5 working days from the order or shipping confirmation.
5.3 After payment, the customer is obliged to accept the goods. Cancellation orders can no longer be considered
5.4 If a delivery does not arrive at the customer's address despite the dispatch or order confirmation, the customer must contact SSMP immediately (see Clause 2 above).
6. Payment modalities
For online orders, customers can pay by credit card (Mastercard, Visa) and other online payment services (Twint, GooglePay). For on-site sales, the customer can pay in cash or by card.
7. assignment
SSMP reserves the right to assign or pledge to third parties the purchase price claims due from the customer in connection with the delivery, including any installments due, default interest and reminder fees.
8. liability
8.1 Any liability for damages, consequential damages and lost profits of any kind suffered by the customer when using SSMP services (including visits to museums and other venues) as well as liability for third-party claims and claims for damages are excluded.
8.2 The liability of SSMP for slight negligence is excluded. Liability for auxiliary persons is completely excluded.
9. data protection
The collection and processing of personal data about the customer by SSMP is explained in the privacy policy. This forms an integral part of these GTC. The privacy policy is available here. By agreeing to these GTC, the customer also declares that they have read and understood the privacy policy.
10 Applicable law and place of jurisdiction
Swiss law shall apply exclusively. The UN Convention on Contracts for the International Sale of Goods is excluded. The place of jurisdiction is Zurich.
